Welcome to Workshop17.

(collectively being: Refuel Properties (Pty) Ltd. with the registration number: 2016/205971/07 & Workspaceman B.V. with registration number: 80703895).

This Privacy Policy applies to Workshop17 services (the “Platform”), which include Workshop17 apps, websites, software and related services accessed via any platform or device that link to this Privacy Policy.

We are committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, share, protect and otherwise process the personal information of users, and other individuals in connection with our Platform. If you do not agree with this policy, you should not use the Platform.

Consent to Processing of Personal Information

By accepting the terms and conditions of this Privacy Policy, you hereby consent to Workshop17 and/or its Corporate Group (described below) processing your personal information, subject always to adherence to Protection of Personal Information Act No.4 of 2013 (hereinafter “POPIA”).

Information we collect

Personal Information:

We may collect information such as your name, username, password, identity number or date of birth (where applicable), photograph, address, email address, contact details, any details required for verification and/or any other information you disclose on your profile or to create an account with Workshop17 or to contact us for support.

Usage Information:

We may collect information regarding how you use the Workshop17 app, including, but not limited to, your interactions, preferences, duration of usage, most used features, user interface behaviour, any in-App purchases (which will include the transaction and payment details), error tracking, location data, Ad interactions, any security features interactions and/or customer support correspondence.

Technical Information:

We may collect certain information about the device you use to access the Platform, such as the model of your device, IP address, mobile carrier, network type, operating system and/or unique device identifiers. Where you log-in from multiple devices, we will be able to use your profile information to identify your activity across devices.

Location Data:

We may collect information about your approximate location, including location information based on your SIM card and/or IP address. With your permission, we may also collect precise location data (such as GPS).

Survey Information:

Any information collected through surveys, research, promotion, contests, marketing campaigns, challenges, competitions or events sponsored by us in which you decide to participate in.

Cookies

We use cookies and other similar technologies (e.g. web beacons, flash cookies, etc.) (the “cookies”) to automatically collect information, measure and analyse how you use the Platform, and this information is used to enhance your experience using the Platform, to improve the Platform. Cookies also allow us to remember your login name during your visit so that you do not have re-enter such information again and again. We also use cookies to monitor Platform visits in order for us to track how many people have engaged with our Platform in a given period. We only use this data in an aggregated way and we cannot trace it back to an individual.

You may be able to refuse or disable cookies by adjusting your device browser settings. Because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to refuse or disable certain types of cookies.

Use of Information

We use your information to improve, support and administer the Platform, to allow you to use its functionalities, and to fulfil and manage the provision of our services. We generally use the information we collect in the following ways:

  • To fulfil requests for products, services, Platform functionality, support and information for internal operations, including troubleshooting, data analysis, testing, research, statistical, and survey purposes and to solicit your feedback.

  • To improve and develop our Platform and conduct product development.

  • To allow you to participate in interactive features of the Platform.

  • To promote our advertising and marketing campaigns to promote the Platform, to invite you to participate in an event, and to promote activities on the Platform.

  • To understand how you use the Platform, including across your devices.

  • To help us detect and combat abuse, harmful activity, fraud, spam, and illegal activity on the Platform.

  • To ensure content is presented in the most effective manner for you and your device.

  • To promote the safety and security of the Platform.

  • To communicate with you, including to notify you about changes in our services.

  • To enforce our terms and conditions of service, house rules and other conditions and policies.

  • To train and improve our technology, such as our machine learning models and algorithms.

  • To deliver and enhance our App’s features and functionality;

  • To facilitate and fulfil sales, promotion, and purchases of goods and services and to provide user support.

  • To analyse user behaviour and improve our App’s performance;

  • To respond to your support requests and provide efficient customer service.

Sharing of Information

Service Providers

We may provide information to service providers who support our business, such as cloud service providers, payment processors, food and beverage operators, analytic providers and other service providers who may from time to time assist us with the security of the Platform, subject to such service provider signing POPIA compliant agreements in order to protect such information.

Our Corporate Group

We may also share your information with other related companies, subsidiaries, or affiliates of our corporate group, including to provide the Platform, to improve and optimise the Platform, to prevent illegal use and to support users.

For Legal Reasons

We will share your information with law enforcement agencies, public authorities or other organisations if we are legally required to do so, or is such is reasonably necessary to:

Comply with a legal obligation, process or request;

Enforce our terms and conditions, member service agreements and/or any other agreements, policies and standards, including investigation into any possible violation thereof;

detect, prevent or otherwise address security, fraud or technical issues;

protect the rights, property or safety of us, our members, a third party or the public as required or permitted by law (including exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction).

Sale, Merger or other Business Transactions

Subject to agreement to protect your information, we may also disclose your information to 3rd parties:

In the event that we sell or buy any business or assets (whether as a result of liquidation, bankruptcy or otherwise) in which case we will disclose your information to the prospective seller or buyer of such business or assets;

if we sell, buy, merge, are acquired by, or partner with other companies or businesses, or sell some or all of our assets. In such transactions, user information may be among the transferred assets.

Storage of Information

Your information may be stored on servers located outside the country where you live, but such servers shall be subject to law and/or agreements that comply with POPIA or an equivalent legislation or regulation.

Retention and Deletion of Information

We retain information for as long as necessary for the operation of the Platform and for the purposes set out in this Privacy Policy. We also retain information when necessary to comply with any contractual obligations and legal obligations and/or for the purposes of legal claims or defences against thereto.

Once it is no longer necessary to retain your information or if you request for the deletion of same, Workshop17 shall delete your information and furnish you with proof thereof if requested.

Your Rights

You have rights and choices when it comes to your information. You may be afforded certain rights under applicable laws, which may include the right to access, delete, update, or rectify your data, to be informed of the processing of your data, to file complaints with authorities, and potentially other rights.

By consenting to this Privacy Policy, you hereby consent and state:

  • I have provided my Personal Information details to the Workshop17 voluntarily;

  • I have provided my Personal Information details personally for the purpose(s) specified above;

  • I am aware of my right as data subject to, at any time, object to the processing of my Personal Information;

  • I am aware of my right to lodge a complaint with the Information Regulator at e-mail address: POPIAComplaints@inforegulator.org.za;

  • I am aware of my right to withdraw my consent at any time;

  • My details may be used for direct marketing or newsletter purposes by Workshop17.

We take steps to ensure that your information is treated securely and in accordance with POPIA. Workshop17 has taken appropriate technical and organisational measures to ensure the security of your information and to prevent unauthorised access or loss of your personal information.

We will, from time to time, include links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any information to these websites.

Privacy Policy Updates

Workshop17 may from time to time update this Privacy Policy and will notify you of such updates by posting a notification on its Platform and such update shall be effective from the date of being posted on the Platform.

Jurisdiction and Applicable Law

This Privacy Policy shall be governed by the laws of the Republic of South Africa and shall be governed by the rules of jurisdiction of the Republic of South Africa.
